The United States Supreme Court has refused to review Rickey Lynn Lewis’ case. The 50-year-old man from Tyler, Texas was convicted of murder, based on eye witness testimony from the victim’s fiancé, who was raped. The United States Supreme Court did not comment on why they chose to not review Rickey’s case.

The execution of Rickey Lynn Lewis is scheduled for 6 pm CDT, on April 9, 2013, at the Walls Unit of the Huntsville State Penitentiary in Huntsville, Texas. Fifty-year-old Rickey is convicted killing 45-year-old George Ray Newman during a robbery of his home in Tyler, Texas in September of 1990. Also during the robbery, Rickey raped George’s fiancée, Connie Hilton. Rickey has spent the past 22 years on death row.
Rickey’s childhood was not easy. His mother, who testified at his trial, said that he was a “bright” child. Once they moved in with his father, Rickey began having problems. Rickey was often beaten by his father, as was his mother. At the age of 10, Rickey shot his father to protect his mother. Rickey completed school through 9th grade. Prior to his arrest for murder, Rickey had twice been convicted of burglary of a building and once for burglary of a vehicle.
On the evening of September 17, 1990, Lewis, along with two other men, broke into George’s house.
It is believed that George and Connie interrupted the burglary. George was shot in the face. Connie was raped and beaten. Lewis threatened to kill Connie. Lewis also killed their dog before leaving in Connie’s car. Lewis was arrested three days after the murder. The other two participants were never caught.
Lewis was given the death penalty twice. The second jury found that he was likely to be a continuing threat to society and that there was no mitigating circumstances to favor a life sentence.
Lewis has since attempted to argue that he is mentally incompetent and ineligible for execution. In 2005, Judge Kent ruled that Lewis was competent. The Texas Court of Criminal Appeals agreed to the ruling. On November 20, 2012, the 5th Circuit Court of Appeals upheld the ruling after Lewis took another IQ test.
Some newspapers have reported that Rickey’s execution will be rescheduled, however, according to the Texas Department of Criminal Justice’s website, Rickey’s execution is still scheduled for April 9, 2013.
