Kevin "Yummy" Mattison, Pennsylvania

Kevin “Yummy” Edward Mattison was scheduled to be executed on Thursday, March 12, 2015, at the State Correctional Institute Rockview in Rockview, Pennsylvania. His execution has been stayed. Thirty-eight-year-old Kevin is convicted of the murder of 34-year-old Christian Agosto during a robbery of Christian’s York, Pennsylvania home on December 9, 2008. Kevin has spent the last four years on Pennsylvania’s death row.

In 1995, at the age of 17, Kevin was convicted and served time for murder in Maryland. Kevin received special education classes while in school. Kevin was married and had two children at the time of the second murder.

On December 9, 2008, Tiffany Kenney, the girlfriend of Christian Agosto, learned that Christian was having an affair. Kevin Mattison, whom Tiffany did not know, agreed to drive Tiffany and her friend to the apartment of Christian. Once they arrived, they attempted to gain entrance to the apartment, but were unsuccessful. The two women returned to the vehicle, where Mattison informed them that he could get them into the apartment.

Mattison, using a screwdriver, picked the lock, gaining access to the apartment. Tiffany and Christian began a verbal and physical altercation, after Christian was caught with another woman. Mattison, who knew that Christian was a drug dealer, decided this was an opportune time to rob the apartment. He entered the apartment with a gun drawn and ordered everyone on the floor. Mattison allowed Tiffany to leave the apartment.

 

Mattison repeatedly asked Christian “Where’s it at?” referring to the drugs. Christian initially denied having drugs at the apartment, although he eventually retrieved them for Mattison. Mattison took the drugs and began walking towards the door. Unprovoked, he turned near the door and fired a single shot at Christian while he was lying on the floor.

 

Mattison ran back to his vehicle and told his companions that Christian had fired at him. Christian died seven days later. Mattison was discovered hiding in an attic in Maryland a month later. He was sentenced to death in 2010. At the time of the murder, Mattison was out on bail for a pending rape charge in Maryland.

 

On Friday, February 13, 2015, Pennsylvania Governor Tom Wolf announced a moratorium on executions in the state. Governor Wolf has announced that all execution in the state of Pennsylvania are on hold until he receives and reviews a report on capital punishment in the state, which was ordered in 2011. In his announcement, he called the death penalty in Pennsylvania a "flawed system," "ineffective," "unjust," and "expensive."
