Wayne Smith, Pennsylvania

Wayne A. Smith was scheduled to be executed on Thursday, March 2, 2017, at the Rockview State Correctional Institute in Rockview, Pennsylvania. His execution has been stayed. Sixty-one-year-old Wayne has been convicted of the murder of 26-year-old Eileen Jones on November 18, 1994, in Eddystone, Pennsylvania. Wayne has spent the last 20 years of his life on Pennsylvania’s death row.

On November 18, 1994, Eileen Jones, mother of two and pregnant with a third child, was at a bar with her boyfriend, John Murray. John and Eileen left the bar around 8:30 pm, to go and visit a friend. Eileen then left a short while later by herself to go visit another friend.

At around 10:30 pm, Eileen, accompanied by an African-American male, Wayne Smith, arrived at the home of Edna. Eileen and her friend did not stay long, as Edna was putting her child to bed.

Around 11 pm, Smith asked to borrow a car from his nephew to take a woman to a motel. The nephew later identified the women as Eileen. The car was returned around 12:30 the next morning. During the afternoon of November 19, 1994, Smith told his brother that he had murdered the woman he was with the night before by strangulation.

 

Eileen’s body was discovered in a nearby creek on November 22, 1994. The cause of death was determined to be strangulation. Smith waived his rights and gave a full confession to the police, alleging that Eileen agreed to have sex with him in exchange for drugs. At some point, Smith became concerned that Eileen would accuse him of rape, so he killed her. Smith also alleged that he was high on cocaine at the time of the murder.

 

Wayne Smith’s execution has been stayed by the US District Court of the Eastern District of Pennsylvania.
